1. Acceptance of Terms

By accessing and using Flow Novel ("the Platform"), you accept and agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations of India. If you do not agree to these terms, please do not use our services.

2. Definitions

• "Platform" refers to Flow Novel website and all associated services.
• "User" refers to any individual who accesses or uses the Platform.
• "Content" refers to novels, chapters, comments, reviews, and any other material posted on the Platform.
• "Intermediary" refers to Flow Novel as defined under Section 2(1)(w) of the Information Technology Act, 2000.

3. Eligibility

• You must be at least 18 years of age, or the age of majority in your jurisdiction, to use this Platform.
• Users between 13-18 years may use the Platform with parental or guardian consent and supervision.
• By using this Platform, you represent that you have the legal capacity to enter into a binding agreement.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You agree to provide accurate, current, and complete information during registration.
• You must immediately notify us of any unauthorized use of your account.

5. User Content and Responsibilities

When you upload, submit, or post content on Flow Novel:

• You retain ownership of your original content.
• You grant Flow Novel a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display your content in connection with operating the Platform.
• You represent that you own or have the necessary rights to the content you post.
• You are solely responsible for the content you post and its compliance with applicable laws.

6. Prohibited Content

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you agree not to post content that:

• Belongs to another person and to which you do not have any right.
• Is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy, hateful, or racially/ethnically objectionable.
• Is harmful to children or adolescents.
• Infringes any patent, trademark, copyright, or other proprietary rights.
• Violates any law for the time being in force.
• Deceives or misleads the addressee about the origin of the message or knowingly communicates misinformation.
• Threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign States, or public order.
• Contains software virus or any other code designed to interrupt, destroy, or limit the functionality of any computer resource.
• Is patently false and untrue, written or published with intent to mislead or harass a person, entity, or agency for financial gain or to cause injury.

7. Intellectual Property Rights

• The Platform design, features, and functionality are owned by Flow Novel and protected under the Copyright Act, 1957, Trade Marks Act, 1999, and other applicable intellectual property laws.
• User-generated content remains the property of respective creators.
• You may not use, copy, or distribute our proprietary content without written permission.

8. Grievance Redressal

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:

• We have appointed a Grievance Officer to address user complaints.
• Complaints can be filed via email to [email protected].
• The Grievance Officer shall acknowledge the complaint within 24 hours and resolve it within 15 days.

9. Content Moderation

As an intermediary under the IT Act, 2000, we:

• Shall remove or disable access to unlawful content within 36 hours of receiving a court order or notification from appropriate government agencies.
• Reserve the right to remove content that violates these Terms or applicable laws.
• May cooperate with law enforcement agencies as required by law.
• Shall preserve content for investigation purposes as required under applicable law.

10. Termination

• We reserve the right to suspend or terminate your account for violations of these Terms or applicable laws.
• You may terminate your account at any time by contacting us.
• Upon termination, your license to use the Platform immediately ceases.
• We may retain certain information as required by law or for legitimate business purposes.

11. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Flow Novel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

13. Indemnification

You agree to indemnify and hold harmless Flow Novel, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or applicable laws.

14. Governing Law and Jurisdiction

• These Terms shall be governed by and construed in accordance with the laws of India.
• Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in [City], India.
• Disputes may also be resolved through arbitration under the Arbitration and Conciliation Act, 1996.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Significant changes will be notified to users via email or prominent notice on the Platform. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
